Below is a list of terms and conditions that you agree to when you purchase a theme package from our website.
Theme & Product Usage
All our themes are licensed under the GPL general public license (see http://www.gnu.org/licenses/gpl.html). With the purchase of any of our themes, you are able to utilize the themes for personal use as well as client work without any limit to the number of times the themes can be used. Our theme packages include support for only those themes which were purchased from this website. Photocrati has the right to change the terms of this website and the licensing of any Photocrati theme or product at any time.
You may not claim intellectual or exclusive ownership to any of our themes or products, modified or unmodified. All products are property of Photocrati. Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
Updates
Theme updates are available to current customers who have made an individual theme purchase and have not requested a refund. Our Themes are always designed to be compatible with the latest available version of WordPress, but we can give no guarantee, that older templates will run with future versions of WP. We are however committed to doing our best to make all the themes compatible with future releases of WordPress.
JWPlayer & NextGEN
Photocrati themes make use of both the NextGen Gallery plugin and the JW Image Rotator. Both are excellent third party applications provided free by their respective creators under certain conditions. We have no copyright or ownership of these applications. The NextGen plugin, as a free WordPress plugin, falls under GNU licensing and may be downloaded, redistributed, and modified. Visit the NextGen Gallery Plugin homepage for more information.
Resale & Distribution
The JW Image Rotator, which is the basis for slideshows in our templates, comes with more restrictive use rights, which you can find on the application’s homepage at LongTail Video. Longtail distributes the JW Image Rotator for free for non-commercial use, but charges a licensing fee for site’s that use the JW Image Rotator for commercial use. Photocrati has purchased an enterprise license from Longtail that gives our customers the right to use the file for any purpose, including commercial. Please note, however, that this license puts some limits on the redistribution of websites using our templates. If you have created a site that is legitimately for your personal use, and later decide to sell it, the license will travel to the buyer of your site. However, the license does not cover unlimited third party redistribution and resale – that is, buying our themes with the intent to develop and resell sites based on them. If you are a developer and would like to commercially resell sites based on our themes, you would also need to purchase a new theme for each of your clients (so they are covered by our license) or you will need to purchase an enterprise license from Longtail that allows you to commercially redistribute the JW Image Rotator.
Themes Compatibility
It is our duty to always keep the themes up-to-date and working with the latest version of WordPress. Our themes are developed and fine-tuned for WordPress 2.9 or higher, any version prior to that may have problems with some theme functionality.
Browser Compatibility
Our themes support all current web browsers including (but not limited to) Firefox 3.5+, Safari, Chrome (all on PC & Mac) & Internet Explorer 7+. Whilst we strive to give everyone a seamless & near-identical experience across each of these browsers, it is impossible to compensate for the lack of web standards support (relating to HTML & CSS) in some of these browsers. IE6 was released in 2001 and according to W3Schools there are only 10% of users left using it. Seeing that there are so few users actually using this browser, we have dropped support for this browser all together.
Our Refund Policy
We offer a 100% No Questions Asked Guarantee. We give you 14 days from your purchase date to try your theme. If you decide it’s not the right solution for you, you can email us or contact us through the member area and we’ll issue a full refund. Easy. No questions asked.
Site Content Copyright
All content, including imagery, published on the Photocrati.com domain, is property of Photocrati and under copyright. Any replicated site content must be authorized and clearly referenced back to the source. Content from the Photocrati web site shall not be used or exploited for any commercial and non-private purposes without the prior written consent of Photocrati.
Warranty
Our themes are guaranteed to function on a clean installation of WordPress or when activated without any changes. Once you modify any of the theme files or include third party applications, then we cannot guarantee that the themes will work. It is our policy to support our themes as best we can, and we will provide support to modified themes or instances of third party applications at our discretion or as time allows.
Theme support
The theme packages that are purchased on this site include support. All support inquiries and questions shall be addressed in the support forum. This is the quickest and most efficient way for anyone who has purchased a theme package to receive support. We do not provide phone support. This also enables us to keep our prices low for you the customer. We offer rigorous support though our support forum. Moreover, the support that we offer shall include common issues and bugs that might occur, and not necessarily customization of any themes. Theme support will only be given to those who purchase a theme package from this website.
When addressing our customers any opinions or advice contained within our site content or forum, is subject to these Terms & Conditions. Reliance upon any information provided by Photocrati is solely at your own risk.
Theme license
The CSS, XHTML PHP, design and any other elements of the Photocrati themes are released under the GPL license and are in total compliance to standards set forth by the authors of that license as well as with WordPress. Theme support will only be given to those who purchase a theme package.
Price Changes & Theme Support Subscription
Photocrati reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, a subscription (or any part thereof) with or without notice. Prices of all themes and products, including but not limited to theme support, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes or notices to the Photocrati website.
